This includes reviews, video content, social media posts and verbal statements.
4. Payments & Billing
4a. Service Setup
A Server Owner enters into a financial agreement when placing an order as laid out in 2a. Term Start Date above. Upon receipt of a Server Owner’s order, StickyPiston uses an automatic process to set-up and make ready the server for use by the Server Owner.
StickyPiston will notify the Server Owner via e-mail (Using the address provided during the order process) when the server is ready.
Fees for the service are payable in advance both on the initial order date and during each renewal period as explained in 2a. Term Start Date.
It is the Server Owners responsibility to manage these payments through their chosen means. StickyPiston is happy to provide support as much as possible in all cases concerning billing but can not handle card details or make payments on the Server Owners behalf.
The Server Owner accepts that, should a payment be missed, they are subject to the terms found in 6. Suspension of Service & Termination.
4b. Provisioning
StickyPiston reserves the right to use an automated provisioning system when server hardware is nearing capacity or at other times that require a more managed set-up of servers through new orders.
In these cases, StickyPiston makes no guarantees of when the server will become active, however, all staff and technical team members operate under an unofficial 24 hour time limit to ensure that a new Server Owner can begin using their service as soon as possible.
4c. Delayed Server Set-up
In cases where provisioning is not in place and the Server Owner does not have their services available to them in the first 24 hours that pass after their payment has been made, a ticket must be opened through the StickyPiston support system to ensure a smooth and efficient solution can be found to remedy the delays.
As stated in 3b. Server Owner Responsibility any other form of contact is no guarantee that StickyPiston staff will be able to respond to problems or find solutions in a timely manner.
4d. Rights to Refuse Service
StickyPiston reserves the right to refuse service at its own discretion until the server is activated and the Server Owner has been notified.
StickyPiston reserves the right to request proof of identity, IP and global location of the Server Owner when an order has been placed to ensure the ongoing security of the company and all its active Server Owners.
4e. Electronic Signature
Any order placed by a user or Server Owner by “click” constitutes acceptance that they are entering into a non-verbal electronic agreement with StickyPiston.
In all cases this Electronic Signature carries the same value as a hand-written signature between the two parties.
Both parties are protected under, and subject to the terms of, the Electronic Communications Act (2000).
4f. Refund Policy
StickyPiston offers a 14 day refund on all services as long as certain criteria are met. The 14 days starts from the time you order the service.
The Server Owner is responsible for contacting StickyPiston through official support channels (See 3b. Server Owner Responsibility) and providing information about their refund request.
For a refund request to be considered, we must receive an official cancellation request through the support ticket system as described in 5a. Notification of Intent to Cancel, please provide clear information about why you are requesting a refund. You can add this information to the cancellation request support ticket.
The refund offered is subject to the discretion of StickyPiston staff and may require the Server Owner to provide further information on the reasons for their cancellation.
StickyPiston offers a “Firm but Fair” refund policy in-house and all staff are trained to be able to judge a Server Owners request impartially and fairly.
If you have paid for multiple months we have the right to not issue a full or partial refund as these payments are outside the first 14 days of your hosting period refund policy. We may provide at our discretion a 4i. server credit refund.
PaySafe card
StickyPiston is unable to offer refunds if a payment is made with a PaySafe card. PaySafe cards use virtual tender that is added to an account. Because of this it is impossible to refund the amount back onto the card and we are unable to refund the amount back onto an alternate payment option for legal reasons. If you have remaining credit on your PaySafe card you may be able to refund that directly through their website here: Contact PaySafe.
4g. Fee Changes & Increases
We reserves the right to alter or raise our fees at any time. Server Owners will be notified of this at least 14 days before their next renewal as explained in 2a. Term Start Date.
The Server Owner is deemed to have accepted the change in fees upon the sending of an e-mail to their provided e-mail address. They are responsible for maintaining their personal information and keeping it up to date.
In all instances, StickyPiston will attempt to mitigate increases to fees in any way they can through other initiatives and projects before passing the increase on to their Server Owners.
4h. Promotions
All promotions are available “While Stocks Last”. StickyPiston does not guarantee the availability of promotions and reserves the right to add, remove or modify any promotion at any time without notification.
4i. Server Owner Credit
When a Server Owner overpays or sends extra payments to StickyPiston, we reserves the right to provide the overpayment as credit on the Server Owners account. This is usually an automatic process controlled by the Billing system. This decision can be disputed by opening a Support Ticket to discuss the matter further.
Server Owner credit holds no physical or digital monetary value when attempting to trade for goods and services outside of StickyPiston.co.
Server Owner credit will never expire but can be lost if a Server Owner completely removes or otherwise closes their account within StickyPistons billing and support system.
Server Owner credit can be used against any purchase on the StickyPiston.co domain and is transferable to other Server Owners through a request placed in a support ticket.
Further information regarding Server Owner credit can be found here: How Server Owner Credit Works.
Customer credit can not be paid-out in any form, to any bank account or services, unless in extenuating circumstances that have been pre-approved by StickyPiston Staff.
4j. Group Pay
StickyPiston provides a service known as Group Pay which allows all members of a server to donate to its running costs through PayPal payments.
It is the responsibility of the Server Owner to arrange, manage and track these payments and the failure to pay could lead to conditions as laid out in 6. Suspension of Service & Termination.
StickyPiston support is available for help with setting up a Group Pay arrangement as well as being able to provide assistance with its ongoing use, however this will never excuse the Server Owner from the terms laid out above.
More information regarding the Group Pay scheme can be found here: Contribute towards your Servers Costs.
4k. Affiliates and Withdrawal of Funds
If you are an affiliate with StickyPiston either through a partnership agreement or other opportunity, you may request a withdrawal of funds once your payout threshold has been reached.
The payout threshold will be different for each affiliate and can be found by logging into your client area and scrolling to the “Affiliate Program” section near the bottom of the page.
If you are able to request a withdrawal of funds, you will be asked to provide a few details and a ticket will be opened. Please allow up to 5 working days for the affiliate withdrawal to be processed and be aware that legal and fraud checks are carried out during this process. Anyone found to be in breach of legal requirements or in breach of any existing partnership or affiliate agreement may be denied their payout.
Payout denials may be challenged and StickyPiston is obligated to freely provide all details regarding the reasoning for the denial as well as any potential solution that can be reached. Furthermore, StickyPiston retains the right to contact relevant authorities if illegal activity is discovered and linked to your Affiliate account.
5. Cancellation of Services
5a. Notification of Intent to Cancel
For a cancellation to be recognised as received by StickyPiston, a Cancellation Request must be placed and sent through the official channels. Information on the process can be found here: Cancelling your Minecraft Server.
StickyPiston agrees that a Server Owner has requested a cancellation from the date and time that this request is made, not from the time that a staff member becomes aware of it.
5b. PayPal Recurring Payments
If a Server Owner has chosen to pay via “PayPal Subscription”, “PayPal Recurring Payments”, “PayPal Automatic Billing Agreement” or any other service provided by PayPal that guarantees payments will be taken on regular, set dates, it is their responsibility to manage this service.
StickyPiston has no control over the payments received through any kind of automatic system established by PayPal and recommends that the Server Owner cancels the arrangement with PayPal at the same time as opening their cancellation request with StickyPiston as explained in 5a. Notification of Intent to Cancel.
Find out more about how to cancel a recurring payment here: Cancelling a PayPal Pre-Approved Payment Plan.
StickyPiston holds no responsibility to notify a Server Owner (past or present), manage payments received or return accidental payments should an Automatic agreement not be terminated correctly. However, if contact is made within 14 days of the accidental payment, a support ticket can be opened and staff can communicate with the user regarding a potential solution to an over-payment in the same way that refunds are handled as outlined in 4f. Refund Policy.
5c. Cancellation Period
When a Server Owner makes a cancellation request they may choose one of two options for the cancellation to come into effect.
“End of Billing Period” will prevent the next Service term renewal (See 2a. Term Start Date) and the services will be closed on that date.
“Immediate” will close the services within 24 hours and the next Service term renewal will not occur.
In both instances, it is the responsibility of the Server Owner to ensure they have retrieved any and all information, data, server files or other assets from their services before the cancellation request comes into effect.
StickyPiston stores backups of all server worlds. More information can be found in 10a. Data Backups.
6. Suspension of Service & Termination
6a. Suspension Process
StickyPiston attempts to provide forewarning to suspension and termination procedures and, in the case of missed payments, the Server Owner is given ten days to pay the outstanding balance before termination occurs.
